Statutory Provisions & Scope

What Is Copyright Registration?

Statutory Framework

Copyright protects qualifying works under the Copyright Act, 1957.

Copyright protection generally arises automatically when a qualifying work is created, and registration is not mandatory for acquiring copyright.

However, the certificate of registration and the entries made in the Register of Copyrights serve as prima facie evidence of the particulars entered therein. It provides a formal public record of the work.

Governed under Indian Copyright Act, 1957

Under Section 13 of the Act, protection subsists in qualifying original works:

  • Literary Works: Books, articles, website content, manuals, compilations and computer programmes / source code.
  • Dramatic Works: Scripts, plays, stage works.
  • Musical Works: Original compositions and notations.
  • Artistic Works: Drawings, paintings, photos, diagrams, maps, charts, logos.
  • Cinematograph Films & Sound Recordings: Recorded audio, films and video works.

Copyright protects expression, not an underlying idea or concept. It does not protect ideas and concepts as such; procedures, processes or methods of operation; mathematical concepts; titles, names, short word combinations, slogans or short phrases by themselves; or material not satisfying statutory criteria.

An application may be made by the author, publisher, owner of copyright or person interested under Section 45. Where the applicant is an owner different from the author, an original NOC from the author is required, along with applicable ownership/assignment documentation.

Where an artistic work is used or capable of being used in relation to goods or services, the application must include a Trade Mark Search Certificate (TM-C) under Section 45. Where capable of design registration, provisions under Section 15 and Rule 70(7) affidavit may also apply.

Under Section 22, copyright for literary, dramatic, musical and artistic works generally lasts for the lifetime of the author plus 60 years. Processing typically involves a mandatory 30-day objection period and takes around 2–3 months in the normal course.

Copyright vs Trademark vs Design

The appropriate form of protection depends on the nature of the intellectual property and how it is used.

Intellectual Property Primarily Protects
Copyright Original creative works and qualifying expression (text, code, art, music, videos)
Trademark Brand identifiers such as names, marks, logos and other source identifiers
Design Visual features of shape, configuration, pattern, ornament or composition applied to an article

Documents Required

Depending on the type of work and applicant, the following may be required:

  • Author details
  • Title and category of the work
  • Nature and description of the work
  • Publication details, where applicable
  • Ownership / assignment documents, where applicable
