Statutory Provisions & Scope

What Is Design Registration?

Statutory Protection

Design registration provides statutory protection for qualifying visual features applied to an article.

This includes its shape, configuration, pattern, ornament or composition of lines or colours, where the features appeal to and are judged solely by the eye in the finished article.

The registration framework in India is governed by the Designs Act, 2000 and the Designs Rules, 2001, as amended. Design protection concerns the visual appearance of the article, rather than its mode or principle of construction or something that is in substance a mere mechanical device.

Governed under Indian Designs Act, 2000

The design generally needs to satisfy applicable statutory requirements:

  • New or original design
  • Not previously disclosed to the public in India or elsewhere before the relevant filing or priority date
  • Significantly distinguishable from known designs or combinations
  • Applied to an article and judged solely by the eye
  • Must not comprise scandalous or obscene matter

Depending on the product and design, registration may relate to visual features such as: Product Shape, Configuration, Surface Pattern, Ornamentation, Composition of Lines or Colours, and Two-Dimensional or Three-Dimensional Visual Features.

Design applications are filed in relation to the applicable class of article using the International Classification for Industrial Designs (Locarno Classification). A design may be registered in not more than one class. Separate applications are required for multiple classes.

A registered design carries copyright for an initial period of 10 years from the date of registration. The period may be extended for a further five years on application and payment of the prescribed fee.

It provides statutory protection to the registered proprietor and a legal basis for action against unauthorised application or imitation of the registered design. Section 22 addresses piracy, including fraudulent or obvious imitation. Registration forms a key part of overall IP strategy.

IMPORTANT CONSIDERATIONS

Public Disclosure & IP Strategy

Public Disclosure Before Filing

Under Section 4 of the Designs Act, a design that has already been disclosed to the public anywhere in India or elsewhere by publication, use or otherwise before the relevant filing or priority date may not be registrable.

Exhibition Exception: Contains a specific provision for certain exhibitions notified under Section 21. Applies only where statutory conditions are satisfied (notice to Controller, filing within 6 months).

Design vs Trademark Registration

Design Registration focuses on qualifying visual features of an article, such as its shape, configuration, pattern or ornamentation.

Trademark Registration primarily protects a trademark used to distinguish the goods or services of one person from those of others. The appropriate form of IP protection depends on the asset and applicable law.

Frequently Asked Questions
