Why Trademark Monitoring Matters
Trademark registration is not necessarily the end of brand protection.
The Trade Marks Registry publishes trademark applications in the Trade Marks Journal, allowing any person to oppose an application within the prescribed period. Under Rule 42 of the Trade Marks Rules, 2017, a notice of opposition is to be filed in Form TM-O within four months from the date of publication of the Trade Marks Journal in which the application was advertised or re-advertised.
The Opposition Window
A trademark application advertised or re-advertised in the Trade Marks Journal may be opposed within four months from the date of publication of the Trade Marks Journal in which the application was advertised or re-advertised, as prescribed under Rule 42 of the Trade Marks Rules, 2017.
Section 21 of the Trade Marks Act, 1999 provides the statutory framework for opposition to registration.
Regular monitoring can help identify potentially relevant applications during this period so that appropriate action can be considered. Monitoring itself does not constitute an opposition or prevent registration.
